Kline to ask Kansas high court to let judge testify in abortion case

 

Johnson County District Attorney Phill Kline plans to ask the Kansas Supreme Court today to let a Topeka judge testify in an abortion case involving Planned Parenthood.

Shawnee County District Judge Richard Anderson oversaw Kline’s investigation of Planned Parenthood while Kline was Kansas attorney general. The judge now is a key witness in a criminal case Kline filed last fall against the Overland Park clinic.

Anderson currently is under orders from the Kansas Supreme Court not to testify. But a Kline spokesman said Kline hopes the court will lift that gag order now that the Kansas Attorney General’s Office on Thursday modified its stance on whether Anderson can retain clinic records.
